Booked Session Schedule Details

The Photographer will make every attempt to keep the slotted time as well as the post production and delivery timelines.   In return, the Client agrees to confirm the scheduled time prior to the session. Any notification of any changes in schedule or location shall be made in a timely manner and confirmation of receipt must be obtained from the Photographer by the Client.  Typically, cancellations are not allowed within 24 hours of a session.

The Process and Payment

Except for longer photoshoots, the booking process is automated.  You will receive an email with a link to schedule your photoshoot.  Upon scheduling the service, I will confirm your time after I verify the the slot is still available.  Unless noted on the service, a deposit will be required prior to booking the session, as part of the scheduling process.  The remainder of the balance is due on the day of the photoshoot.

Longer photoshoots have more pre-planning, including a Zoom call to discuss your goals and establish the concepts, as well as additional services such as makeup, hair and a stylist.  Clients can work with the photographer on wardrobe. Booking will be done on a personal basis as part of the zoom call.

Payments will be accepted via your customer portal or with Venmo, Cashapp, Zelle, Paypal and Cash.

Deliverables

The amount of images you receive is subject to the service you booked.   Typically, I will cull the photos, selecting the best images and will share the low resolution un-retouched photos in a password protected gallery.  You can then select your favorites based on the amount of images purchased (additional are always available as an add-on).  Once you are finished, I will complete post-production and deliver digitals to you, with the goal to complete the process in 10 working days, unless an arrangement is made.

Warranties

  1. The Client acknowledges that the Photographer cannot warrant certain poses or coverage quality.
  2. The Client further acknowledges that the Photographer shall not be held responsible for compromised coverage due to interference from the guests or due to environmental issues, such as poor lighting, space, or backdrops if the session is out of studio.
  3. The Photographer warrants that the photos shall not infringe upon any third party’s patents, trademarks, trade secrets, copyrights, or other proprietary rights.
  4. The Photographer agrees to make every effort to provide satisfactory coverage, but cannot make any promises as to specific poses or looks during the Session.  
  5. The Photographer warrants that it shall provide services and meet its obligations under this Contract in a timely and efficient manner.

Post Production and Editing
The final post-production and editing styles, effects, and overall look of the photos are left to the discretion of the Photographer. Clients will have the ability to select which photos are edited prior to post-production.

Archive and Storage
The Photographer archives all photographs produced as a result of the Session for a period of 12 months from the date of the Session. After that time, the Photographer deletes all photographs from its storage. The Photographer is not responsible for the photographs once they are delivered to the Client. The Client is solely responsible for keeping the photographs in a safe place and for making back-up copies of any photographs that are delivered to the Client.

Copyrights
The Photographer reserves the full copyright to all the photos taken during the photography shoot. Sale, publication, or any other commercial use of the photo by the Client is specifically prohibited without the prior written consent of the Photographer.  The Client may use the images for personal use including posting on social media and printing for personal display, as well as for agency portfolios.   Any use by 3rd parties (except the client’s signed agencies) must have the approval of the Photographer.

Limitation of Liability

  1. If the Client has any claim or cause of action against the Photographer, whether arising in tort or contract, even if based on or caused by the Photographer’s negligence, the Client’s recovery and the Photographer’s liability is limited to the total amount paid by the Client to the Photographer under this Contract, and the Photographer shall have no further liability to Client.
  2. The Photographer shall not be liable for the loss of images after the final delivery to the Client of all products as per the scope of work for the Session.

These Terms are Non-Negotiable.
